PEACE Programmes Learning Platform Terms and Conditions of Use
1. General Terms and Conditions
1.1 Please read the following Terms and Conditions. By continuing to access the PEACE Programmes Learning Platform (Platform), you (the "user") will be deemed to have accepted these Terms and Conditions. These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and the parties submit to the jurisdiction of the Irish courts. This, however, shall not prevent the Special EU Programmes Body (SEUPB) from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of this Agreement in any other jurisdiction. If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable, such Term or Terms shall be severed and deleted from the clause concerned and the remaining Terms and Conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
1.2 Please note that unauthorised use or downloading of material from the Platform is absolutely prohibited. For further information please refer to the PEACE Programmes Learning Platform section of the SEUPB's Privacy Notice
1.3 Use of the Platform constitutes your acceptance of these Terms and Conditions which take effect when you first use this Platform. The SEUPB reserves the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions will be reflected online and are accessible here. Your continued use of this Platform after changes are posted constitutes your acceptance of this agreement as modified by the posted changes.
1.4 Whilst the SEUPB endeavours to ensure that the Platform is normally available 24 hours a day, the SEUPB will not be liable, if for any reason, the Platform is unavailable at any time or for any period. Access to this Platform may be suspended temporarily or permanently and without notice. Whilst the SEUPB endeavours to ensure that the information on this Platform is correct, no warranty, express or implied, is given as to its accuracy and the SEUPB does not accept any liability for error or omission.
1.5 Part of this Platform contains materials submitted to the SEUPB by and/or produced by third parties. Due to the nature of the Platform and the volume of materials contained within it, the SEUPB has used a working assumption that all information is compliant with national and foreign laws. The SEUPB also cannot guarantee the accuracy of this material and hereby expressly disclaims any responsibility for error, omission or inaccuracy in the material, misinterpretation and any/or all loss, disappointment, negligence or damage caused by reliance on the material contained on this Platform or any failure or alleged failure in the delivery of the services referred to herein, or in event of the bankruptcy, liquidation or cessation of trade of any company, individual or firm referred to herein.
1.6 The SEUPB shall not be liable for any damages (including, without limitation, damages for loss of business or loss of profits) arising in contract, tort or otherwise from the use of or inability to use this Platform, or any material contained in it, or from any action or decision taken as a result of using this Platform or any such material.
1.7 The SEUPB’s policy is to continue to improve the Platform on an on-going basis. We therefore welcome all feedback which will inform these changes including the reporting of any errors of fact or recommendations in relation to the addition/amendment of information. Specific details on our complaints policy and procedure, including how to register a complaint or request the amendment or removal of materials from Platform are outlined in our FAQ Section
1.8 The SEUPB accepts no responsibility for the content of any site to which a hyperlink from the Platform exists. The linked sites are not under the control of the SEUPB and the Body is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. The SEUPB is only providing these links as a matter of convenience to the users and is not to be implied as an endorsement of the linked site. The SEUPB has no responsibility or liability of any kind for the accuracy or content of any information or any other aspect of any such sites. These sites also have their own policies and practices about on-line privacy and the SEUPB cannot be responsible for their privacy practices. If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable, such Term or Terms shall be severed and deleted from the clause concerned and the remaining Terms and Conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
2. Data Processing and Privacy Policy
2.1 We will only be processing the personal data for those who register for an account with the Platform, details of how and when we will process your personal data are included within the SEUPB’s Privacy Notice, which can be accessed HERE The appropriate GDPR documentation has been completed for the Platform, which is also available upon request by emailing peaceplatform@seupb.eu
3. Terms of Use
3.1 The following sets out terms of use for anyone accessing and using the Platform. These terms of use govern how you may access and use the Platform and all associated web pages within it, which is provided by us free of charge. You should read these terms carefully before using the Platform.
3.2 By accessing or using the Platform or otherwise indicating your consent, you agree to be bound by these terms, which supplements the above General Terms and Conditions and our Copyright Statement. The Copyright Statement can be accessed HERE If you do not agree with or accept any part of these terms, you should stop using the Platform immediately.

3.4 In these terms:
‘we’, ‘us’ or ‘our’ means the SEUPB; and
‘you’ or ‘your’ means the person accessing or using the Platform or its content.
3.5 Acceptable use
We permit you to use the Platform only for personal, non-commercial purposes and primarily for researching purposes on the PEACE programme. Use of the Platform in any other way, including any unacceptable use set out in these terms of use, is not permitted.
3.6 Unacceptable use
As a condition of your use of the Platform, you agree not to use the Platform:
3.6.1 for any purpose that is unlawful under any applicable law or prohibited by these terms of use or ourgeneral Terms and Conditions as detailed above;
3.6.2 for any purposes beyond the Acceptable Use in clause 3.5;
3.6.3 to commit any act of fraud;
3.6.4 to distribute viruses or malware or other similar harmful software code;
3.6.5 for purposes of promoting unsolicited advertising or sending spam;
3.6.6 to simulate communications from us or another service or entity in order to collect identity information, authentication credentials, or other information (‘phishing’);
3.6.7 in any manner that disrupts the operation of our Platform or business or the website or business of any other entity;
3.6.8 in any manner that harms minors;
3.6.8 to promote any unlawful activity;
3.6.9 to represent or suggest that we endorse any other business, product or service unless we have separately agreed to do so in writing;
3.6.10 to gain unauthorised access to or use of computers, data, systems, accounts or networks; or to attempt to circumvent password or user authentication methods.
3.7 Registration and password security
3.7.1 Use of the Platform may require registration, particularly in order to access restricted areas of the Platform.
3.7.2 We are not obliged to permit anyone to register with the Platform and we may refuse, terminate or suspend registration to anyone at any time.
3.7.3 You are responsible for making sure that your password and any other account details are kept secure and confidential.
3.7.4 If we have reason to believe there is likely to be a breach of security or misuse of the Platform through your account or the use of your password, we may notify you and require you to change your password, or we may suspend or terminate your account.
3.7.5 Any personal information you provide to us as part of the registration process will be processed in accordance with our Privacy Notice
3.8 Infringing content
We will use reasonable efforts to:
3.8.1 delete accounts which are being used in an inappropriate manner or in breach of these terms of use; and
3.8.2 identify and remove any content that is inappropriate, defamatory, infringes intellectual property rights including copyright or is otherwise in breach of these terms of use;
3.8.3 when we are notified, but we cannot be responsible, if you have failed to provide us with the relevant information;
3.8.4 if you believe that any content which is distributed or published by the Platform is inappropriate, defamatory or infringing on intellectual property rights, you should contact us immediately at peaceplatform@seupb.eu
3.9 Bulletin boards, chat rooms and other interactive services
3.9.1 We may make communication services (Bulletin Board) available on the Platform. We are not obliged to monitor or moderate any text, images, video, audio or other multimedia content, information or material (Submission) submitted to our Bulletin Board.
3.9.2 Where we do monitor or moderate Submissions we shall indicate how this is performed and who should be contacted in relation to any Submission of concern to you.
3.9.3 You must not assume a false persona or identity when using the Bulletin Board.
3.9.4 We may remove or edit any Submission to any of our Bulletin Board whether they are moderated or not.
3.9.5 Any Submission you make must comply with our Submission standards set out in clause 4 below.
3.9.6 By making a Submission, you grant to us a royalty-free, irrevocable, non-exclusive, transferable licence to use, reproduce, modify, publish, edit, translate, distribute, perform and display the Submission (in whole or in part) on the Platform, and on any other websites operated by us, indefinitely.
4. Submission standards
4.1 Any Submission you make to our Bulletin Board and any other communication to users of our Platform by you must conform to standards of accuracy, decency and lawfulness, which shall be applied in our discretion, acting reasonably. In particular, any Submission or communication by you must be:
4.1.1 your own original work and lawfully submitted;
4.1.2 factually accurate or your own genuinely held belief;
4.1.3 provided with the necessary consent of any third party;
4.1.4 not defamatory or likely to give rise to an allegation of defamation;
4.1.5 not offensive, obscene, sexually explicit, discriminatory or deceptive; and
4.1.6 unlikely to cause offence, embarrassment, or annoyance to others.
5. Linking and framing
5.1 You may create a link to our Platform from another website without our prior written consent, provided no such link:
5.1.1 creates a frame or any other browser or border environment around the content of our Platform;
5.1.2 implies that we endorse your products or services or any of the products or services of, or available through, the website on which you place a link to our Platform;
5.1.3 displays any of the trademarks or logos used on our Platform without our permission or that of the owner of such trademarks or logos; or
5.1.4 is placed on a website that itself breaches these terms of use.
5.1.5 We reserve the right to require you to immediately remove any link to the Platform at any time, and you shall immediately comply with any request by us to remove any such link.
6. Using our name and logo
6.1 You may not use our trademarks, logos or trade names without prior permission. If you are seeking permission to do so you must contact us directly at peaceplatform@seupb.eu. Permission is not guaranteed and is at the discretion of the SEUPB.
7. Ownership, use and intellectual property rights
7.1 The intellectual property rights in the Platform and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from the content are owned by us and our licensors. 7.2 Nothing in these terms of use grants you any legal rights in the Platform or the Content other than as necessary for you to access it. You agree not to adjust, try to circumvent or delete any notices contained on the Platform or the Content (including any intellectual property notices).
8. Breach
8.1 We shall apply these terms of use in our absolute discretion. In the event of your breach of these terms of use we may terminate or suspend your use of the Platform, remove or edit Submissions, disclose Submissions or any other communication to users of our Platform by you to law enforcement authorities or take any action we consider necessary to remedy the breach.
